Privacy Policy

ComSpan Communications, Inc. (ComSpan) respects the privacy interests of each of its customers, prospective customers, and visitors to its websites. This Privacy Policy explains how ComSpan keeps those interests in mind as it receives information regarding customers and web visitors and uses that information to serve our customers and web visitors more effectively.

1. Information Collected.
In order to provide our customers with better service, ComSpan collects information about its customers and web visitors. Information can be obtained in a number of ways, including written or telephone communications from prospective customers, website registrations, and customer contracts. The information obtained can be generic or personally identifiable.

2. Generic Information.
Generic information (that is, information that does not reveal the person's or entity's identity) is often gathered when a visitor enters the ComSpan website and a "cookie," or small piece of data, is automatically stored on the visitor's computer hard drive. Subject to the customer's ability to "opt-out" from cookies as described at Part 6 below, cookies allow ComSpan to "remember" a website visitor the next time the person visits a website. ComSpan may also gather and use aggregate Internet Protocol (IP) addresses from visitors' computers to analyze trends, track visitor preferences, and gather broad demographic information. This information helps ComSpan determine visitors' interests so that we may tailor our websites to better meet visitors' needs.

3. Personally Identifiable Information.
ComSpan receives personally identifiable information (that is, information that identifies a particular person, such as name, address, telephone number, or e-mail address) in two basic ways: 1) through visitors' use of ComSpan's websites; and 2) through information voluntarily provided by the customer and/or prospective customer-such as when a customer makes a purchase or uses a credit card to pay for services. ComSpan uses this information provided by the customer for such necessary functions as processing orders and billing for services.

ComSpan will never disclose personally identifiable information to others in order for them to market their products and services to our customers. Subject to the customers' opt-out choices as described in Part 6 below, ComSpan may use personal information collected to inform the customer of additional products and services we offer. ComSpan may also share personal information with some service providers, affiliates, partners, and other third parties in order to:

  • Enable and enhance our ability to provide our products and services;
  • Enable those parties to perform services on our behalf, such as mailing or bill processing, in connection with the products and services that we provide to the customer;
  • Enable ComSpan to provide our obligations to sales agents (if applicable), such as the validation of commissions owed.

4. Exceptions and Limitations.
Occasionally, ComSpan may be required by law enforcement or judicial authorities or other legal process to provide information collected from its customers and web visitors. We will disclose such information upon receipt of a court order or subpoena, or in order to cooperate with law enforcement or comply with legal process.

ComSpan reserves the right to share information when it believes, in its sole discretion, that it is necessary to: prevent unlawful use of communications services; repair or restore network outages; answer an emergency situation (e.g. 911 calls, matters of public safety); or protect the security or integrity of ComSpan or its websites. In addition, ComSpan may monitor the areas of communication of any kind (i) to satisfy any law, regulation, or government request (e.g. response to law enforcement-issued subpoena); (ii) if such disclosure is necessary or appropriate to operate ComSpan (e.g. recording of our Customer Care calls); or (iii) to protect the rights or property of ComSpan or others (e.g. to prevent fraud).

ComSpan provides goods and services to business and residential customers. ComSpan may share information relating to the customer and/or the customer's products and services obtained or accessed, including, without limitation, bill balance and payment information, purchases, and registration information, with the customer or approved contact. A representative of the customer or company sharing information with ComSpan should have no expectation that this information will not be shared with the company.

If all or a part of ComSpan's business is sold, merged, or otherwise transferred to another entity, ComSpan reserves the right to transfer information collected from customers or visitors as part of the transaction. In connection with a proposed sale, merger, or other transfer of all or a part of ComSpan's business, we may disclose information collected from customers or visitors to a potential acquirer, subject to that party's agreement to maintain the collected information according to reasonable and customary confidentiality obligations.

ComSpan cannot safeguard any information that is disclosed or stored in a public space, including on any bulletin board, chat room, or the website ComSpan hosts for customers as part of its services. Additionally, ComSpan's websites may contain links to sites that belong to third parties unrelated to ComSpan. ComSpan assumes no responsibility for the content accessible on such sites, or the privacy practices of those content providers, and recommends that visitors to those sites review each site's privacy policy statement.

5. Customer Proprietary Network Information.
Certain information relating to the customer's use of our telecommunications products and services, commonly referred to as "Customer Proprietary Network Information," or "CPNI," is subject to certain federal and state CPNI laws and regulations. ComSpan is fully committed to complying with these CPNI laws and regulations. ComSpan will limit the use or disclosure of information collected from our customers to the extent necessary to comply with the applicable federal or state CPNI law or regulation, even if such use or disclosure would otherwise be permitted under this Privacy Policy.

6. Customer Options Regarding ComSpan's Collection and Use of Information.
The customer has the right to block the use of cookies through the customer's internet browser or other commercially available software. This will, however, limit the functionality that ComSpan can provide the customer when visiting the website.

A customer may review or update the personally identifiable information we have received by contacting ComSpan by phone at 1-866-535-9858 (24 hours/7 days a week)

7. Protecting the Privacy of Children.
ComSpan's website is not intended for persons under 13 years of age. We do not knowingly solicit or collect personal information from or about children, and we do not knowingly market our products or services to children.

8. Agreement to Abide by This Policy.
Use of ComSpan's goods, services, or website constitutes the user's acknowledgement of this Privacy Policy and agreement to be bound by it.

International users acknowledge and agree that information that is submitted to ComSpan will be collected, processed, stored, disclosed and disposed of in accordance with applicable U.S. law.

ComSpan may modify this Privacy Policy, effective upon posting the modified policy on ComSpan's website; user's continued use constitutes acknowledgement of the modified version and agreement to be bound by it. Unless ComSpan indicates otherwise, the current Privacy Policy version applies to all information that has been collected from a person or entity.

9. Security.
ComSpan employs many different security techniques to protect Customer information from unauthorized access by users inside and outside the company. ComSpan uses industry standard practices to safeguard the confidentiality of Customer personally identifiable information, including "firewalls" and Secure Socket Layers.
